2. TERMS OF SERVICE

These Terms govern your use of thestickahport.com and any order you place with The Stickah Port ("we," "us," "our"), a brand operated by JBaumStudios LLC, a Massachusetts limited liability company doing business as The Stickah Port.
By using this site or placing an order, you agree to these Terms.
1. YOUR ARTWORK AND INTELLECTUAL PROPERTY
This section is important. Please read it carefully.
1.1 You Warrant That You Own the Rights
By uploading artwork, text, logos, images, QR codes, or any other content to our site, you represent and warrant that:
- You own all rights to that content, or you have obtained explicit written permission or a valid license from the rights holder to reproduce it commercially
- Your content does not infringe any copyright, trademark, trade dress, patent, right of publicity, right of privacy, or any other right of any third party
- Your content is not defamatory, obscene, unlawful, or in violation of any applicable law
- You have the legal authority to grant us the license described in 1.3
1.2 We Do Not Verify Ownership
We are a printing service. We do not review, research, or verify whether you own the rights to the artwork you upload. You are solely responsible for determining that you have the right to reproduce your content.
Accepting and printing your order is not a statement by us that your artwork is legally cleared for use.
1.3 License You Grant Us
You grant us a non-exclusive, royalty-free license to reproduce, modify, resize, and process your artwork solely as necessary to produce, fulfill, and ship your order, and to retain files for reorder and record keeping purposes.
We do not claim ownership of your artwork. We will not sell your artwork, use it in our own products, or license it to anyone else.
We will not use your artwork in our marketing or on social media unless you separately opt in during checkout. That permission is optional, your order ships either way, and you can revoke it at any time by emailing us.
1.4 Indemnification
You agree to indemnify, defend, and hold harmless JBaumStudios LLC, The Stickah Port, and its owners, members, employees, and contractors from and against any and all claims, demands, damages, losses, liabilities, judgments, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Any claim that your artwork infringes or misappropriates the intellectual property rights of any third party
- Any claim arising from the content, message, or subject matter of your artwork
- Your breach of any representation or warranty in these Terms
This obligation survives the completion of your order and the termination of these Terms.
1.5 We May Refuse Any Order
We reserve the right to refuse, cancel, or halt any order at our sole discretion, at any time, including after payment, for any reason. Reasons may include artwork that we believe:
- Infringes a third party's copyright or trademark
- Reproduces a brand, logo, character, or packaging trade dress you do not appear authorized to use
- Depicts hate speech, harassment, threats, or incitement to violence
- Is sexually explicit or sexualizes minors
- Promotes illegal activity, or imitates the packaging of regulated products such as cannabis, tobacco, alcohol, or pharmaceuticals in a way that could mislead consumers or violate labeling law
- Impersonates a real person, business, or government agency
If we cancel an order for any of these reasons, we will refund you in full. We are not obligated to explain our reasoning, and we are not liable for any loss you incur as a result of the cancellation.
1.6 Notice of Infringement
If you believe content we have printed infringes your intellectual property, contact us at support@thestickahport.com with a description of the work, the allegedly infringing material, your contact information, and a statement made in good faith that you are authorized to act on behalf of the rights holder. We respond promptly to valid notices.
2. ORDERS, PROOFS, AND APPROVAL
Our builder generates a live preview showing your artwork and the cut line we will follow. You must affirmatively approve that preview before checkout.
Your approval is the final proof. We produce from what you approved. It is your responsibility to review spelling, layout, cut line placement, size, quantity, material, and finish before approving.
You may optionally request a manual proof from our team during checkout. If you do, we will email you a proof and will not begin production until you approve it. Requesting a manual proof extends your turnaround time.
3. PRICING, PAYMENT, AND ERRORS
All prices are in US dollars. Payment is processed at checkout by Shopify and its payment providers. We do not store your payment card information.
We reserve the right to correct pricing errors, including after an order has been placed. If a price was listed incorrectly, we will contact you with the corrected price and give you the option to proceed or receive a full refund.
4. PRODUCTION TIME AND SHIPPING
We currently ship within the United States only. If we begin offering international shipping, rates and terms will be shown at checkout.
Production times listed on our site are estimates, not guarantees, and begin after your artwork is approved. Shipping times are controlled by the carrier and are outside our control.
Risk of loss passes to you when the carrier takes possession. We will assist with carrier claims for lost or damaged shipments, but we are not liable for carrier delays.
Incorrect shipping addresses supplied by you are your responsibility. Packages returned to us due to an incorrect address may be reshipped at your expense.
5. PRODUCT DESCRIPTIONS AND VARIATION
We describe our products as accurately as we can, but we do not warrant that descriptions, colors, or images are error free.
Custom printed products naturally vary slightly between production runs. Minor variation in color, cut position, and finish is normal and is not a defect. Our standard cut tolerance is approximately 1/16 inch.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to your order or these Terms is limited to the amount you paid for that order.
We are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost business opportunities, or costs of substitute goods, even if we were advised of the possibility of such damages.
Nothing in these Terms limits liability that cannot be limited under applicable law.
7. DISCLAIMER OF WARRANTIES
Except as expressly stated in our Refund Policy, our products and this site are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that stickers will adhere permanently to every surface, or that they will perform as expected in every environment. Adhesion depends on the surface, its preparation, temperature, and conditions of use. Test one sticker before applying an entire order.
8. ACCOUNTS AND ACCEPTABLE USE
You are responsible for the accuracy of information you provide and for maintaining the security of any account credentials.
You agree not to use this site to transmit malicious code, attempt to gain unauthorized access to our systems or data, scrape or harvest data, circumvent any security or rate limiting measure, or upload files intended to disrupt our services.
9. THIRD PARTY SERVICES
Our site uses third party services including Shopify, payment processors, shipping carriers, and email providers. Your use of those services may be subject to their own terms and policies.
10. GOVERNING LAW
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any dispute arising out of these Terms or your order shall be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts, and you consent to the jurisdiction of those courts.
11. CHANGES
We may update these Terms at any time. The version posted at the time you place an order governs that order. Continued use of the site after changes are posted constitutes acceptance.
12. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
